Frequently asked
Who is the legal employer, and who manages the employee?
HR4U JSC signs the employment contract and is the employer under Vietnamese law. You set the role, manage performance, approve leave and decide compensation. Our agreement with you mirrors your policies into the local contract.
Can HR4U employ foreign nationals in Vietnam?
Our EOR service currently covers Vietnamese nationals. If you need to relocate an expatriate to Vietnam, tell us and we will point you to a work-permit specialist we trust.
Do we need to pay the 13th-month salary?
It isn't required by law, but almost every Vietnamese employee expects it, and offers without it lose candidates. We recommend budgeting one month's salary, paid before Tết, and we handle the PIT treatment.
What happens when we want to move staff to our own entity?
You transfer them whenever you're ready. We end the HR4U contract lawfully, close the social-insurance record and hand over the labour history so seniority is preserved. There is no exit fee.
How do you handle termination?
Vietnamese law limits unilateral termination to specific grounds and notice periods. We advise on the lawful route — mutual agreement, end of definite term, or unilateral with cause — prepare the documents and calculate severance. Most exits are agreed and settled within the notice period.
Can employees be paid in USD?
Vietnamese nationals must be paid in VND. You are invoiced in USD; we convert at the rate stated on the invoice.
Where is employee data stored?
On servers in Vietnam, as required for Vietnamese personal data under Decree 13/2023. We sign a data-processing agreement with every client and can support GDPR obligations for EU clients.
